Buying a Farmhouse in Morni Hills: The Papers Are Different

With a built property you are buying two things — the land and the building — and each has its own paperwork. What to ask for that you would not ask for on bare land.

Buying a farmhouse means buying land with something on it, and the something has its own set of questions. Most buyers check the land papers carefully and take the building on trust, which is the wrong way round given that the building is where the money went.

The land side

Everything that applies to a plot applies here: jamabandi, mutation, khasra map, non-encumbrance certificate, classification. Nothing changes.

One thing to watch: if the land under the house is recorded as agricultural, ask how the building came to be there and whether it was ever regularised. This is more common than buyers expect and it affects both lending and resale.

The building side

  • When was it built, and by whom?
  • Was any approval taken at the time?
  • Has it been extended since, and was that approved?
  • What repairs have been done, and when?
  • Is there a borewell, and was it registered if required?
  • Is the electricity connection in the seller's name?
  • Are there any dues outstanding on utilities?

Unpaid utility dues transfer with the property in practice, if not in law, because the connection is what you need restored.

Put anything you expect to remain into the agreement by name. "It was there when I saw it" is not a term of sale.

Money side

Stamp duty and registration are calculated on the collector rate or the price, whichever is higher, and a built property attracts a higher valuation than bare land. Get the figure from the tehsil before you agree terms.
